PART 1 — POLICIES & PROCEDURES
Welcome to Vishoka Wellness
Vishoka Wellness, LLC ("Vishoka Wellness," "we," "us," or "our") offers in-person and remote wellness services for individuals and groups, including exercise, breathwork, stress management, meditation, mindfulness, yoga, sleep hygiene, dosha evaluation, and gut health and nutrition guidance (collectively, "Wellness Services"). We are dedicated to helping our clients live healthier, more balanced lives.
Please read this document carefully. It governs the terms of our relationship while you receive Wellness Services. By enrolling or participating, you agree to these terms.
1. Wellness Services Are Not Physical Therapy or Medical Care
Although our principal holds a physical therapy license, Wellness Services are not physical therapy, medical care, or any other licensed healthcare service. Our work together does not create a provider-patient relationship. Wellness Services — including techniques, poses, postures, routines, recommendations, and exercises — may not be appropriate for everyone.
If you have medical concerns, please schedule an appointment with your healthcare provider. Wellness Services are not a substitute for professional medical advice or treatment.
2. Communications Policy
By providing your contact information or initiating communication with us via phone or email, you authorize us to contact you by email, phone call, voicemail, and text message. We use this information for service-related purposes only (reminders, invoicing, and client support — not marketing).
You understand that unencrypted emails and text messages may not be fully secure.
3. Payment & Cancellation Policy
Payment: All sessions, classes, and workshops are prepaid. Payment is due before your scheduled session. We accept credit and debit cards. We do not accept insurance, as Wellness Services are generally not insurance-covered. You are solely responsible for all fees.
Cancellations & No-Shows: We do not offer refunds, credits, or makeup sessions for missed or cancelled appointments.
To cancel or reschedule, please contact us during business hours at least 24 hours before your appointment.
For Monday classes, please cancel by 12:00 p.m. on the preceding Friday so we can offer your spot to another client.
For online sessions, the same 24-hour cancellation policy applies.
We do not offer makeup sessions for any programs, classes, or workshops. Please review the FAQ section on our website for more details.
4. Additional Policies
Substance Use: We will not provide Wellness Services to anyone under the influence of recreational drugs or alcohol. If you arrive to a session in this condition, we will end the session immediately and may re-evaluate our continued work together.
Class Observation: Due to space limitations, parents, guardians, and third parties may not observe wellness classes or sessions. Please contact us if you have questions about this policy.
Child Abuse Reporting: In accordance with Texas law, we are required to report all reasonable suspicions of child abuse or neglect to local law enforcement or the Texas Department of Family Protective Services (CPS). When professionally appropriate, we will notify a guardian before making a report.
5. Indemnification & Assumption of Risk
As a condition of receiving Wellness Services, you agree to indemnify Vishoka Wellness against all claims, liabilities, losses, damages, suits, costs, and expenses (including reasonable attorney's fees) arising from:
Your failure to follow our instructions;
Failure to communicate problems encountered during services; or
Failure to update us about changes to your health.
You also agree to assume all risk of property damage, injury, or death resulting from such failures.
6. No Warranty
While we strive to provide accurate and valuable guidance, we make no warranty as to the effectiveness of our Wellness Services for your specific situation. We disclaim all liability for direct, indirect, implied, punitive, special, incidental, or consequential damages arising from use of our Wellness Services. All services are provided "as-is" without additional warranty.
7. Disclaimer
Vishoka Wellness owns all original educational materials presented as part of this wellness program (including sessions, worksheets, workshops, and recommendations). Your participation does not create a provider-patient relationship or any duty for us to follow up with you.
All content is for educational and informational purposes only — it is not medical advice, physical therapy advice, or any other licensed healthcare guidance. If you have individualized health concerns, please consult your licensed healthcare provider.

8. Remote Wellness Services — Privacy & Technology
Privacy & Security: Our remote technology platforms use network and software security protocols to protect your confidentiality and comply with applicable privacy laws. We use platforms that meet relevant safety standards and provide sufficient quality for effective Wellness Services delivery.
Benefits: Remote platforms allow convenient, high-quality access to Wellness Services from anywhere.
Risks: Risks may include insufficient transmission quality (e.g., poor video resolution), technical failures, or the possibility that information could be accessed by an unauthorized party.
Alternatives: You may choose to discontinue remote Wellness Services at any time.
9. Agreement & Informed Consent
By enrolling or signing, you confirm the following:
Agreement to Terms: You have read and understood this entire document, agree to be bound by all provisions, have truthfully provided the information requested, and will notify us of any changes to your health.
Payment Authorization: You authorize your credit card to be charged for Wellness Services at the time of purchase.
No Recording: You agree not to record, screenshot, photograph, or otherwise capture any portion of our Wellness Services — including programs, classes, workshops, or presentations — whether delivered in person or remotely.
Remote Platform Agreement: To access remote services, you may be required to agree to additional terms and conditions of the third-party platform used.
Informed Consent: You acknowledge and agree that:
Wellness Services are not medical services and are not intended to diagnose, cure, or treat any illness;
Wellness Services are generally not covered by insurance, and you are solely responsible for payment;
You assume all risks associated with participation in Wellness Services; and
You agree to indemnify Vishoka Wellness for any loss, damage, or injury incurred during Wellness Services, to the extent permitted by law.
PART 2 — WEBSITE TERMS & CONDITIONS
1. Agreement to These Terms
Welcome to the Vishoka Wellness website ("Website"). By using this Website, you agree to be bound by these Website Terms & Conditions ("Terms") and our Privacy Policy. The Website is for educational purposes only and does not constitute licensed healthcare services, physical therapy, or medical advice.
Vishoka Wellness, LLC, a Texas limited liability company, owns and manages this Website. We may update these Terms at any time without notice. Your continued use of the Website constitutes acceptance of any updated Terms.
2. Scope of These Terms
These Terms govern your access to and use of the Website, its content, software, and any applications created by Vishoka Wellness, including those accessible via social media or affiliated platforms.

4. Do Not Share Protected Health Information (PHI)
Because this Website does not comply with HIPAA, do not transmit, store, or share protected health information (PHI) through this Website unless directed to a designated HIPAA-compliant portal.
If you share PHI in violation of these Terms, you agree to indemnify Vishoka Wellness against any resulting claims, liabilities, losses, or expenses (including attorney's fees).
5. Your Use of Website Content
Unless otherwise stated, Vishoka Wellness (or its licensors) owns all Content on this Website, protected by U.S. and international copyright and trademark law.

These Terms and our Privacy Policy constitute the entire agreement between you and Vishoka Wellness regarding this Website. Vishoka Wellness may amend these Terms at any time. Your continued use of the Website constitutes your acceptance of any changes.
15. Affiliate Disclosure
Vishoka Wellness may include affiliate links on this Website. We may receive compensation if you purchase products or services through those links. We only recommend products and services we believe will add value to our visitors.
PART 3 — MEDIA RELEASE & MARKETING AUTHORIZATION
This is a voluntary legal document. Signing is not required to receive Wellness Services.
What This Covers
This Release applies to any photographs (digital or physical), video recordings, and audio recordings collected by Vishoka Wellness ("Media-Related Information").
Biometric & Privacy Law Compliance
To the extent that photographs or videos contain biometric identifiers, you acknowledge that this Release:
Informs you that biometric identifiers or biometric information may be collected and stored;
Explains the purpose and duration for which such information may be collected, stored, and used;
Constitutes your written authorization and consent to collection, storage, use, and disclosure of such information; and
Confirms that Vishoka Wellness stores, transmits, and protects biometric information using industry-standard reasonable care, applying the same or greater protections as it applies to other sensitive information.
To the extent other applicable privacy laws govern the Media-Related Information, this Release constitutes your informed consent to disclose it for Vishoka Wellness's marketing purposes.
Purpose of Collection
Vishoka Wellness collects photographs, videos, and audio recordings for use in its marketing and promotional materials.
Right to Revoke & No Compensation
You may revoke this authorization at any time by notifying us in writing at the email address listed on our website. However, once Media-Related Information has been published online, Vishoka Wellness cannot guarantee its removal, as third parties may have already re-shared it. Revocation applies only to future disclosures.
You acknowledge that:

You grant Vishoka Wellness the right to reproduce, edit, display, copyright, and publish the Media-Related Information, in whole or in part, for any lawful marketing purpose.
You agree to indemnify Vishoka Wellness against any claims, liabilities, losses, or expenses (including attorney's fees) arising from third-party claims related to Vishoka Wellness's use of the Media-Related Information.
Acknowledgment
By using our services or signing this document, you confirm that:
You have read and understood this Media Release;
The Media-Related Information may no longer be protected from re-disclosure without your consent once published; and
You are legally bound by the terms of this Release.
